What Is Expungement?
Expungement is a legal process by which you can clear your criminal record. Once you complete the expungement process, it will be as if your marijuana conviction never happened. Your conviction will no longer show up in background checks, and the associated police reports will no longer be available to law enforcement. Oregon’s Senate Bill 420, which became effective in early 2020, made it simple to expunge your marijuana record.
Expunging Your Record in Oregon
You can expunge your marijuana conviction in Oregon if you are eligible. Requirements include the following:
- You did not possess more than four cannabis plants
- You did not possess more than eight ounces of usable marijuana
- You did not deliver, process, possess, or manufacture more than 16 ounces of cannabinoid concentrates
- You did not deliver more than one ounce of usable marijuana
- You did not possess, process, deliver or manufacture more than 72 ounces in liquid form and 16 ounces in solid form of cannabinoid products
